TERMS OF USE – AUDIO BETA
Effective as of 01/01/2025
Article 1. Purpose
These Terms of Use (“Terms”) define the legal framework governing access to and use of the DIVIN software in its beta-test phase, provided by the company DIVIN AUDIO (“the Publisher”).
By signing up and using the beta version of the software, the user (“the Beta Tester”) fully and unconditionally agrees to these Terms.
DIVIN AUDIO reserves the right to unilaterally modify these Terms at any time.
Article 2. Beta access
The DIVIN software is made available free of charge as part of a testing program (“Beta Test”). Access to this beta version is temporary and limited to users selected by DIVIN AUDIO.
Access and use of the software are subject to the completion and approval of a registration form, as well as compliance with these Terms.
DIVIN AUDIO reserves the right to revoke access to the beta software at any time, without prior notice.
Article 3. Nature of the Beta Test and Disclaimer of Warranty
The DIVIN software is provided “as is” for testing purposes. It may contain errors, bugs, or malfunctions that affect its performance. Accordingly:

DIVIN AUDIO does not guarantee the stability or performance of the software.

The Beta Tester uses the software at their own risk, with no guarantee of compatibility with their tools.

DIVIN AUDIO shall not be held liable for any data loss, hardware issues, or impact on the Beta Tester’s audio productions.
Article 4. Data collection and use
As part of the Beta Test, DIVIN AUDIO collects certain information related to the use of the software in order to improve its performance.
Collected information includes:

Data provided in the registration form (email, user profile, software used, etc.)

Voluntary feedback and comments shared by the Beta Tester

Anonymous usage data (e.g., encountered errors, performance metrics, etc.)
All data is processed in accordance with the DIVIN AUDIO Privacy Policy.
Article 5. Use of Feedbacks and Suggestions
The Beta Tester agrees that any experience reports, suggestions, or feedback they provide may be freely used by DIVIN AUDIO, with no obligation of compensation or acknowledgment.
DIVIN AUDIO reserves the right to incorporate these suggestions into future products, without limitation.
Article 6. Usage restrictions
The Beta Tester agrees to the following restrictions:

Do not distribute, sell, or share the DIVIN software with third parties

Do not attempt to analyze, decompile, or modify the software

Do not use the software for commercial or professional purposes outside the Beta Test framework
Any breach of these obligations may result in immediate revocation of access to the software and legal action where applicable.
Article 7. Support and Communication
As part of the beta program, DIVIN AUDIO may contact the Beta Tester via email to:

Inform them of software updates and bug fixes

Collect feedback and improve the product

Offer future product developments
The Beta Tester may opt out of these communications at any time by emailing contact@divinaudio.com.
Article 8. Intellectual Property
DIVIN AUDIO retains full ownership of the DIVIN software and all its components (source code, interface, algorithms, etc.).
No rights are transferred to the Beta Tester.
Article 9. End of the Beta Program
DIVIN AUDIO may terminate the beta phase at any time.
The Beta Tester acknowledges that access to the software may be revoked without notice.
Upon termination of the program, the Beta Tester agrees to stop using the software and uninstall it from their systems.
Article 10. Goverving law and disputes
Les présentes CGU sont soumises au droit français. Tout litige relatif à leur interprétation ou à leur exécution sera soumis à la compétence exclusive des tribunaux français.
